Commit “La Baloise” to comply with its obligations
Judge Philippe Nazé and his two associate judges forced “La Baloise” to comply with its obligations and ordered it to pay procedural compensation.
The arguments are complex and technical, but lead to a clear conclusion: “There is a difference between a genuine monthly contract and a system that provides for deferred payment of premiums”.
That is what the judgment states “The green card certainly only constitutes a rebuttable presumption of insurance (which may be contradicted by evidence to the contrary), but that the green card in this case covered several months, which shows that it was not a matter of monthly contracts.”
It is now up to the companies to find the methods to avoid possible misinterpretations should other similar cases arise.
